Separate the Master’s record from the SARS record
The trust’s legal and tax records serve different purposes. The Master’s Letters of Authority identify the authorised trustees. SARS allocates an income tax reference through its tax-registration process. Neither a trust deed nor the Master’s reference should be entered as though it were the trust’s income tax number.
The SARS registration guidance explains the separate application route. Do not assume that a lawyer, bank or trustee completed that step merely because the trust has been established or has opened an account.
Ask the person who handled formation what was actually submitted and obtain the outcome document. A fee description saying “trust setup” is not enough to show which institutions were dealt with. Keep the Master’s record, tax registration and eFiling access information separately identifiable in the handover file.
Check whether an income tax number already exists
Search the trust’s records for a SARS registration notice, prior return, assessment or correspondence showing the trust’s own tax reference. Confirm that the name and legal identity match. A trustee’s personal tax number is not a substitute.
If an adviser previously managed the trust, request the registration notice and a list of outstanding tax matters through the authorised handover. Where the record cannot be found, use the official SARS enquiry process with proof of authority to establish the position.
A missing login or inaccessible profile does not prove the trust is unregistered. Creating another application without checking can complicate the records. State clearly whether the problem is a missing tax number, an unavailable notice or lack of access to an existing account.
Record the outcome of the check. The next person should be able to see why a new application was necessary or which existing reference must be used.
No income does not remove the registration question
The current SARS trust FAQ says South African-established trusts must register regardless of transactions or income. Do not wait for a first rental receipt or beneficiary payment before investigating an unregistered trust.
Foreign trusts need a separate scope review. The detailed SARS guidance identifies circumstances involving South African trade, source income and relevant capital gains or losses. A foreign address alone does not settle the South African position, and the rules should not be reduced to a blanket assertion about every trust worldwide.
If an older trust has never registered, provide the true formation and activity history. Do not enter a recent date simply to make the application appear current. Ask the adviser to identify prior returns and other obligations that may need to be regularised alongside registration.
Which trust documents should you gather before approaching SARS?
Prepare the current trust instrument, the Master’s Letters of Authority where applicable, the resolution appointing the representative taxpayer, and identity and address evidence required for the people and route involved. Add the completed IT77TR application and any existing SARS correspondence.
The SARS supporting-document matrix distinguishes trust types and whether a representative, practitioner or person with a once-off mandate is applying. Use the relevant column rather than assuming one checklist fits every case.
| Situation | Document focus | Preparation question |
|---|---|---|
| Inter vivos trust | Deed, amendments and applicable Letters of Authority. | Does the pack show the current governing terms and trustees? |
| Testamentary trust | The final will and applicable authority records. | Have you supplied the instrument that actually created the trust? |
| Foreign trust | Foreign instrument and evidence relevant to its South African position. | Which registration and identification requirements apply? |
| Special-trust classification sought | Additional evidence supporting the particular classification. | Do the facts meet the category, beyond the trust’s chosen name? |
| Practitioner or once-off applicant | Mandate and supporting applicant information. | Does the authority cover this trust and the requested action? |
Special-trust evidence depends on the category. The SARS matrix identifies disability-related evidence for relevant Type A cases and beneficiary age and relationship evidence for relevant Type B cases. Obtain advice on eligibility and the current documents rather than treating a label in the deed as approval.
Check the quality and consistency of the pack
Read every scan before submission. Check that pages are complete, signatures are visible and amendments can be linked to the original instrument. Label the files clearly enough to distinguish the deed from a later amendment and an old authority record from its replacement.
Compare names, identifying details and addresses across the application and evidence. Explain genuine changes instead of silently choosing one version. If a required record is unavailable, identify the issuing institution and the proper replacement route; do not recreate an official document yourself.
Also gather any existing financial statements, bank records and activity history for the adviser’s review. These are useful for identifying the trust’s wider tax position, even where they are not all required as standard registration attachments. For instance, an old trust may have earned interest without making payments to beneficiaries. That history should be disclosed so the registration enquiry does not leave earlier compliance work unidentified. Keep registration evidence and return-preparation records clearly labelled, and submit the material requested for the actual process.
Keep the trust’s address evidence distinct from the representative’s residential evidence. They answer different questions even when the addresses happen to be the same. Check the current certification and document requirements for the actual submission rather than assuming an old copy will be accepted.
Prepare an index showing each requirement, the file supplied and any unresolved query. This makes it easier to respond if SARS requests a clearer copy or additional evidence. Retain the exact submitted set, not only the source folder that may later be updated.
Appoint the representative and confirm trustee authority
The person dealing with SARS needs the proper capacity and authority. The registered-representative guidance explains the nomination and update process. A practitioner’s mandate and the trust’s representative appointment are related but distinct records.
The current trust FAQ states that a newly appointed trustee must have the Master’s written authorisation before acting in that capacity. A signed internal resolution alone does not permit the person to proceed as trustee while the necessary amended Letters of Authority are still pending.
Identify who will receive correspondence and answer verification questions. If the trust’s normal administrator has left, resolve the authority and access position through the official process. Do not use the former administrator’s personal credentials as an informal handover method.
Submit and track the actual registration request
- Confirm whether the trust already has an income tax reference.
- Identify its type and the applicable registration requirements.
- Confirm the authorised representative and applicant.
- Complete the current application using verified records.
- Check and index the supporting documents.
- Submit through the official online-query route or an appointed SARS branch visit.
- Save the acknowledgement and respond to further requests.
- Check the registration notice and retain the confirmed details.
The SARS Online Query System guide explains the digital process. Follow the current requirements for the trust’s case. An upload confirmation establishes that material was submitted, not that every detail has been approved.
If a response is unclear, quote the case reference and identify the missing outcome. Avoid submitting repeated new registrations to chase one pending request. Keep a short correspondence log so the adviser can see what SARS has asked for and what has already been provided.
Plan the duties after receiving the number
Registration is the start of ongoing administration. The September 2026 SARS filing guidance reminds trustees to verify registered details and prepare financial and supporting records for returns. Confirm the applicable return types and filing periods for the trust.
Maintain accounting records even where money has not been distributed. Income, expenses, assets, liabilities and beneficiary rights may still need to be reported. The no-distributions record guide addresses that separate task.
For trust income tax registration support, give Vatco the formation records, registration check and indexed document pack. Explain any missing authority, old correspondence or historic activity. That allows the enquiry to focus on the real registration gap and the work needed after it is resolved.
