UNDERSTAND THE BALANCE

Find out what is owed, why and for which periods.

Begin with the current account position, not an estimated total remembered from an old notice. List the relevant tax types, periods, assessments, penalties and interest separately. Keep any demand or collection correspondence with its date and reference. The stage of the matter affects which actions need attention first.

Compare the account with returns submitted and payment evidence. A balance may involve an established liability, an allocation problem or an amount you believe is incorrect. These situations should not be blended into one request to “negotiate the debt.” Understanding the source of the balance is essential before proposing how it will be addressed.

  • Tell us about any current arrangement, previous default or formal dispute. Do not omit an inconvenient part of the history to make the application appear simpler.
  • The initial review should produce an understandable account of the problem, the evidence available and the next suitable route.
  • Where a legal or contested matter needs specialist attention, that should be identified rather than hidden inside a routine administrative engagement.
YOUR SITUATION

Is the problem affordability, an incorrect balance or a failed arrangement?

Debt accepted, cash temporarily constrained

Prepare a credible payment proposal with current financial evidence.

  • Show ordinary operating costs and ongoing tax obligations beside the proposed instalment.
  • Separate confirmed receipts from hoped-for contracts.

Balance or assessment disputed

First establish whether the issue is allocation, missing records or a formal dispute.

  • Bring assessments, account statements and payment references.
  • An affordability application is not a substitute for the correct dispute procedure.

Previous arrangement failed or compromise considered

Give the full history and explain what has changed.

  • Keep the earlier terms, missed-payment facts and current financial position.
  • A compromise is conditional and distinct from requesting more time to pay.

SUPPORT THE PROPOSAL

Make the repayment proposal credible.

Prepare current financial information that explains both the problem and the proposed solution. The exact package depends on the request, but the figures should be internally consistent and capable of being supported.

The purpose of the preparation is a reasoned application that SARS can assess, not an optimistic monthly amount chosen only to obtain an initial agreement.

  • Affordability reviewAccounts, bank records and asset-liability schedule

This can include available accounts, bank records, assets and liabilities, customer amounts outstanding and expected cash receipts.

  • Business repayment proposalOperating commitments and proposed cash plan

For a business, show ordinary operating commitments alongside the proposed instalment. A plan that uses every expected receipt to repay old debt may fail if it ignores salaries, suppliers and new tax obligations.

  • Expected incomeDebtor receipts and signed contract evidence

Distinguish confirmed receipts from hoped-for contracts so the proposal is not built on income that may never arrive.

  • All proposalsExplanation of the difficulty and corrective changes

Explain what caused the difficulty and what has changed. A temporary timing problem should be supported differently from a sustained inability to pay.

  • Earlier terms existPrevious arrangement and default history

If a previous arrangement failed, provide the facts rather than conceal it.

  • Debt position to establishSARS statements, assessments and collection notices

Keep each tax type and period visible, with payment proofs and the latest dated correspondence.

CHOOSE THE RIGHT PROCESS

An instalment request, compromise and dispute are different.

Payment arrangement

A payment arrangement concerns how an established debt will be paid, usually because immediate settlement is difficult.

  • SARS may consider a qualifying request but can decline it, and interest can continue on unpaid debt.
  • A proposed instalment should therefore be based on an honest view of available cash and continuing obligations.

Compromise request

A compromise is a separate, conditional process through which SARS may consider accepting less than the full debt.

  • It is not a standard discount available to every taxpayer, and submitting an application does not establish that relief will be granted.
  • The supporting financial picture and statutory criteria matter.

Dispute or collection-related request

A dispute concerns whether an assessment or decision is correct.

  • That requires the relevant grounds and procedure rather than an affordability argument alone. Collection-related requests also have their own requirements.
  • We help clarify the route within the agreed scope and do not promise that an enquiry, objection or proposed payment automatically pauses all collection activity.
  • If formal proceedings are underway, provide the documents promptly for an appropriate review.
THE AGREEMENT MUST BE REAL

Prepare, submit and keep the response visible.

  1. 01

Agree the debt and filing work

We first agree the debt-review scope and identify missing returns or other matters that need attention.

    • SARS’s guidance makes current compliance an important part of a payment-arrangement request. Historic filing work may therefore need to be planned alongside the affordability review, with separate responsibilities and fees.
  2. 02

    Prepare and approve the proposal

Next, prepare the relevant request, supporting explanation and financial information through the appropriate authorised channel.

    • Review the proposed terms carefully before submission.
    • Keep the acknowledgement and the complete information used, so any later question can be answered against the same application rather than a changing set of figures.
  3. 03

    Record the SARS response

When SARS responds, record whether the request was approved, declined or requires more information.

    • An application in progress should not be described as an agreement.
  4. 04

    Manage approved terms or reassess

If terms are approved, make the payment dates, references and continuing conditions clear to the person who will manage them.

    • If it is declined, the next route should be reassessed on the facts instead of promising that repeated submissions will inevitably succeed.
MAKE THE PLAN SUSTAINABLE

Keep new obligations from becoming the next problem.

A repayment plan needs regular monitoring. Keep evidence of each instalment and compare it with the tax account so allocation issues are identified. If the business cannot meet a condition, seek advice promptly rather than wait for the arrangement to fail without an explanation.

Your quote should identify the account review, application preparation and follow-up included. Disputes, extensive record reconstruction and legal proceedings may require additional scope. We do not guarantee debt reduction, cancellation of interest or prevention of enforcement. The practical commitment is to explain the position, prepare a supported request where appropriate and hand over the actual outcome with the next responsibilities clearly recorded.

  • Give ongoing returns and current liabilities their own place in the cash plan. Paying old debt while neglecting new obligations can undermine the recovery effort.
  • Where recurring bookkeeping or tax submissions are needed, agree those services explicitly instead of assuming a debt-support project covers all future administration.

YOUR QUESTIONS. A CLEARER NEXT STEP.

Tax debt and payment arrangements:
frequently asked questions.

01Can SARS allow me to pay in instalments?

SARS can consider a payment arrangement where the applicable criteria are met. Approval is not automatic. Provide the complete debt position, outstanding compliance matters and a supported affordability picture so the request can be assessed on its merits rather than on a proposed monthly amount alone.

02Will interest stop when I ask for an arrangement?

Do not assume that it will. SARS guidance states that interest accrues on unpaid debt. We distinguish application preparation from the authority’s decision and the actual terms of any agreement. Review those terms and the account position before relying on a particular settlement amount.

03Is a compromise the same as a payment plan?

No. A payment plan concerns repayment terms, while a compromise is a separate conditional request relating to settlement of the debt. It requires its own assessment and supporting information. Discuss the conditions and evidence for the specific request. A proposed payment plan or compromise needs SARS consideration; submitting it does not itself change the amount owed.

04What if I believe the tax amount is wrong?

Bring the assessment, calculation and evidence supporting your concern. A dispute about correctness is different from inability to pay an accepted liability. The relevant procedure and any collection-related request need to be considered separately; an affordability letter does not replace a properly prepared dispute.

05Can you help if I missed an earlier arrangement?

We can review the history and current circumstances. Explain why the earlier terms were not met and provide evidence of what has changed. A new request is not guaranteed, and omitting the default would prevent a realistic assessment of the available options.

06What should I send first?

Describe the tax types involved, whether there is a current demand or arrangement and whether the amount is disputed. Keep the latest statements and correspondence ready for the agreed review. Avoid sending passwords or an unstructured private financial archive through the initial public enquiry.
