Confirm the legal change before changing access
Obtain the current Letters of Authority and the documents recording the appointment, resignation, removal or death involved. Check what has actually taken effect. An intention to appoint someone is different from the Master’s written authority for that person to act as trustee.
The current SARS trust FAQ expressly addresses a new trustee whose amended Letters of Authority are pending. The person may not act as trustee, engage with SARS in that capacity or manage the trust’s tax affairs before the required authorisation is issued.
Keep the appointment resolution and the official authority together, with their dates clearly identified. Where the records disagree, resolve the discrepancy through the appropriate legal process. Do not alter an older authority letter to make it show the intended new position.
If a filing matter is urgent while the change is pending, identify who presently has lawful authority and obtain advice on the available official route. Urgency does not authorise a person to impersonate the departing trustee or use their personal credentials.
Identify every record affected by the change
| Record | What to check | Why it is separate |
|---|---|---|
| Master’s authority | Who is authorised to act as trustee. | It establishes trustee capacity. |
| SARS trustee particulars | Whether the tax record shows current information. | A legal change may not yet be reflected. |
| Representative taxpayer | Who is nominated to represent the trust to SARS. | Not every trustee necessarily holds this role. |
| Correspondence details | Where notices and enquiries are directed. | A working login does not prove notices reach the right person. |
| Practitioner mandate | Who is instructed and for which work. | Professional appointment differs from trustee capacity. |
| User permissions | Who can view, prepare and submit. | Access must match current authority and duties. |
Create a change list for the trust rather than treating the profile as one switch. Record the responsible person, evidence and confirmation needed for each item.
Check whether the representative taxpayer also changes
A trustee can leave without being the person currently registered as the trust’s representative. Conversely, the departing trustee may be the only person receiving tax correspondence and managing the profile. Establish which situation applies before selecting a SARS update request.
The SARS registered-representative guidance explains nomination and updates through eFiling or the Online Query System. Obtain the trustees’ resolution supporting the nominated representative and the other evidence required for that person’s capacity.
Check that the resolution identifies the correct trust and the intended role. A general engagement letter with an accountant does not necessarily appoint the representative taxpayer. Equally, appointing a representative does not by itself define every practitioner’s access or responsibility.
Where the former representative has died, cannot be contacted or refuses to cooperate, prepare the current authority records and approach SARS through the official process. A fresh tax registration should not be used as a workaround for an access dispute.
Prepare the supporting records before submission
The trust supporting-document guidance covers registration and changes in registered particulars. Select the requirements for the trust type and the person making the request.
Start with the current trust instrument and amendments, relevant Letters of Authority, appointment resolution, identifying records and address evidence. Include the mandate where an adviser or once-off applicant acts. Check whether additional records are needed for the specific change.
Compare names and identifying details across the pack. Explain a legitimate change with its evidence instead of switching spelling between documents. Read every scan and preserve complete pages, including signatures and endorsements needed to understand the document.
Keep old records in the history folder, clearly labelled as superseded. They may explain previous returns or transactions, but should not be accidentally submitted as proof of the present trustee position. Maintain an index identifying which version supports each declaration.
Update the tax record and check the result
SARS’s ITR12T preparation guidance tells trustees to verify contact, address, banking and main-trustee details before completing the return. Review the relevant registered particulars rather than merely changing information in a private spreadsheet.
Follow the current official update process for the affected field. Some changes may prompt verification or further documents. Keep the submission reference and respond to the actual request received, using the trust’s existing tax identity.
After processing, inspect the recorded details and correspondence destination. A saved form, upload receipt or successful login does not by itself establish that every requested change is complete. Note any outstanding verification and who will follow it up.
Compare the trust’s tax reference with the existing registration notice throughout the change. Replacing a trustee normally concerns the administration of the same trust, so an unchanged tax number is not itself an error. If there has also been a structural change, termination or creation of another trust, disclose that separately for legal and tax review. Do not confuse a person’s departure with the creation of a new taxpayer or move historic returns to another entity’s profile.
Do not make unrelated banking changes merely because a trustee changed. If a genuine banking update is required, treat it as its own controlled task with the proper authority and evidence. Keep its confirmation distinct from the representative update.
Review access without sharing personal passwords
List current users and service providers, their roles and the work they actually perform. Confirm that the trust can obtain its records and receive notices through authorised people. Review the departing person’s access when their duties end.
Use appropriate eFiling permissions and practitioner arrangements. The access-handover guide sets out a broader verification and revocation process. Trustee authority still needs the trust-specific evidence described here.
Arrange a controlled check that the incoming authorised person can view the correct trust, relevant tax products and recent correspondence. Avoid testing access by submitting a return or changing bank details unnecessarily. Record the result and any missing permission.
Retrieve working papers, prior submissions and open-case references before the old administrator’s access is removed, where possible. If records are unavailable, make that a documented recovery task rather than assuming the profile itself contains the full accounting history.
Preserve responsibility for work already underway
A representative change does not close an outstanding return, verification request, objection or payment issue. Prepare a handover list showing the period, current position, next action and person responsible. Include relevant deadlines from actual notices rather than relying on memory.
Identify drafts that have not been submitted and submissions awaiting an outcome. The distinction prevents an incoming trustee from assuming a saved return is complete. Include the evidence used for figures that are still under review.
For a fictional trust changing its main trustee during a verification, the incoming team should receive the SARS request, the documents already sent and any unanswered questions. Re-sending a different version without explanation can create avoidable confusion.
Review any standing instructions to the practitioner. Confirm who authorises future submissions and who checks the financial information. The new arrangement should be explicit enough that both trustee and adviser know what remains their responsibility.
Close the change with a verification record
- Confirm the trustee’s lawful authority.
- Identify the affected particulars, representative and access rights.
- Prepare the current supporting evidence.
- Submit the appropriate official update requests.
- Track verification and retain the outcomes.
- Check recorded details and authorised access.
- Transfer outstanding work and supporting records.
- Remove obsolete permissions and preserve the history.
The SARS Online Query System guide provides current process guidance. Keep case references in one handover record so another trustee can establish what was completed.
For trust tax-profile support, provide the old and current authority records, SARS registration notice and precise mismatch. Explain whether the issue is trustee information, representative authority or access. That distinction helps direct the request to the correct process.
