B-BBEE

B-BBEE stands for Broad-Based Black Economic Empowerment. It is a South African legal and policy framework for broader black participation in the economy. A business's status is assessed under the applicable codes. The appropriate evidence may be an eligible sworn affidavit, a qualifying CIPC certificate or a verification certificate, depending on the entity and the rules that apply.

What B-BBEE means

B-BBEE concerns economic participation and transformation under legislation and codes of good practice. It is broader than the percentage of shares held by black owners. Depending on the applicable code and measurement route, relevant elements can include ownership, management control, skills development, enterprise and supplier development, and socio-economic development.

A B-BBEE status level communicates an outcome under the applicable framework. Understanding that outcome requires knowing which entity was measured, which code applied and what evidence supports the assessment. A number copied from a supplier form says little if it cannot be matched to the correct business and document.

The general codes are not the only possible framework. Sector codes can contain different definitions, thresholds, measurement requirements and evidence rules. The business's actual activities therefore matter when deciding how its B-BBEE position should be established.

Why the evidence route matters

Customers and procurement teams may request B-BBEE evidence when assessing suppliers. The request should be answered with evidence appropriate to the business and the particular procurement requirements. Acceptance by one customer does not establish that the same document meets every other customer's or tender's requirements.

Some qualifying entities can use a sworn affidavit rather than a full verification certificate. A CIPC B-BBEE certificate is another route for qualifying entities within its scope. These are specific alternatives with conditions, not documents that every company may choose between freely.

Start with the relevant code, turnover evidence and ownership records. The guide to choosing an affidavit or certificate route develops that sequence. Keep the supporting records used for the statement so that the figures, ownership and period can be explained if queried.

A commissioner of oaths witnessing an affidavit does not perform a full B-BBEE verification. The person making the declaration remains responsible for an accurate statement. A template is a way to record qualifying facts, not a way to create them.

Illustrative example: choosing the correct document

A small business receives a supplier questionnaire asking for its B-BBEE status. The owner finds an affidavit template used by a friend in another industry. Before completing it, the business checks whether its own activities fall under a sector code and whether its size and ownership meet that route's requirements.

The owner reconciles the turnover information to the relevant financial records and checks the ownership information against the company's securities records. If the selected route is appropriate, the business completes the correct document and retains its supporting evidence. If it is not appropriate, it investigates the required verification route.

What B-BBEE does not establish

B-BBEE evidence is not a company registration certificate, a SARS tax compliance result or a guarantee of winning a tender. Those documents and decisions answer different questions. A contractor's cidb grade also describes a different assessment and cannot substitute for B-BBEE evidence.

A shareholding label alone does not settle every measurement issue, and a change in ownership may require the business to reconsider whether its existing evidence remains accurate. Do not simply reuse an old document because its design looks official. B-BBEE evidence assistance should begin by confirming the applicable code, actual business records and the evidence requested.
